Last week, Rhode Island became the 43rd state to pass eminent domain reform. While reform is welcome, it is very weak reform. Instead of banning takings for economic development, it merely specifies the conditions necessary in order for municipalities to invoke eminent domain for economic development. It does, however, offer some protection for property owners, as it requires that owners be compensated 150% of their property value.
